This Privacy and Security Policy ("Privacy Policy") addresses our use and disclosure of information we collect from you on our product platforms and corporate web site. The product platforms are:

Our privacy practices comply with the U.S.-EU Safe Harbor and U.S.-Swiss Safe Harbor Programs as set forth by the Department of Commerce regarding the collection, use, and retention of data from the European Union and Switzerland, respectively. This Privacy Policy applies to all data and information that INTTRA may obtain about you, in connection with its provision of the INTTRA systems defined below, including, without limitation, the Websites and transmissions via electronic data interchange ("EDI") (collectively referred to as the "System"), and all related services (provision of the System and all related services are collectively referred to as the "Services"). This Privacy Policy should be read in conjunction with one or more agreements between your company (the "Company") and INTTRA (the "Agreement(s)") that apply to the System and the Services and with any other documents or guides that are provided from time to time in relation to the Services.
INTTRA recognizes the importance of protecting the privacy of users of the System ("Users") and this Privacy Policy sets forth INTTRA's practices with respect to the collection, use and disclosure of personal data of Users.

Collection and Use of Personal Data

Your personal data (which includes your name, job title, contact details including business telephone and fax number and e-mail address) may be collected through the System and through e-mail and other correspondence with INTTRA as well as from third parties, or by any other means, in connection with providing a Service to you on our behalf. We also may collect sensitive information, such as invoice/payment information or tax ID in connection with specific INTTRA products. We will not share, sell or trade your personal data with third parties for promotional purposes without your consent.

INTTRA and/or its affiliates and third party service providers may use the personal data to:

(a) perform the Services or in connection with the operation of the Service;

(b) monitor and analyze System activity including how the System is used, and the volume and frequency of access, so as to improve the System and the Services;

(c) contact you regarding your inquiries, your use of the System, changes to the System or the Services and to otherwise operate the System;

(d) comply with any applicable law or other legal or regulatory requirements, to respond to a request or subpoena by a government, regulatory or judicial authority, where necessary in connection with a dispute, actual or potential litigation or other legal process or an internal or external audit, or where otherwise necessary to protect the interests of INTTRA, its affiliates, third party service providers or other participants in the System; and

(e) supplement your personal data with third party sources for background verification.

With your consent, INTTRA and/or its affiliates may use the personal data to market products and services of INTTRA and/or its affiliates and third party service providers to your Company through use of post, fax or by e-mail; please note that if we send marketing materials to you from INTTRA we will include a working unsubscribe link so you can unsubscribe.

In addition, any third party offering a service directly to your Company in connection with our Services or on our Websites (including, without limitation, live chat service providers, e-mail service providers and recruiting platforms) (collectively "Partners") may use your personal data to: (a) provide the services; (b) contact you regarding your inquiries; and (c) market its products and services to your Company through use of post, fax or by e-mail.

Third party personal information may also be entered on our System, such as if your Company has elected to use an administrator to enter the personal data about its users. If this data is collected on our System, it will only be used for the stated purpose for which it was collected.

Disclosure of Personal Data

INTTRA and/or its affiliates, third party service providers and Partners may disclose your personal data to:

(a) any affiliate, agent or sub-contractor of INTTRA, and/or its third party service providers or Partners, as applicable, including companies that provide technical services to INTTRA, such as data processing companies. For the avoidance of doubt, a carrier that is a participant in the System is not considered to be a company that provides technical services to INTTRA;

(b) any affiliate, agent or sub-contractor of INTTRA and/or its third party service providers or Partners, as applicable, for the purposes of operating the System and, with your consent, for the marketing and/or provision of third party services. As stated above, all of the third parties offering services through the System may receive your personal data;

(c) any affiliate, agent, sub-contractor or adviser of INTTRA and/or its third party service providers or Partners, or a government, regulatory or judicial authority, as applicable, in connection with an internal or external audit or examination, a dispute or actual or possible litigation, a request, subpoena or similar legal process, to satisfy a port, state or customs security initiative, or where disclosure is otherwise permitted or required by law;

(d) any affiliate, agent, sub-contractor or adviser of INTTRA, and/or its third party service providers or Partners, or a participant in the System, or a government, regulatory or judicial authority, as applicable, where necessary to protect the interests of INTTRA, the public, or other participants in the System, for example, in the event of suspected fraud or illegal activity; and

(e) anyone to whom you authorize INTTRA to give your personal data, including parties you have authorized to access your personal data in connection with your enrollment as a User and as otherwise provided in this Privacy Policy.

In the event that INTTRA, or any of its assets, are acquired or become the subject of a merger, then your personal data may be transferred with the business or disclosed to potential acquirers or others involved in any such transaction, but shall not otherwise be sold or rented to any third party. You will be notified of this change as described below in "Changes to this policy".

You acknowledge that INTTRA is not responsible for information or data in the possession of third parties, except for data processors acting on behalf of INTTRA, regardless of how such data was obtained. Please consult the privacy policies of these third parties to learn how they may use or disclose your information. You may be contacted directly by an individual carrier.
Aggregate or other information not identifiable with any individual may be used or disclosed for other purposes, and to other parties, as deemed appropriate by INTTRA subject to any obligations of confidentiality under the Agreement(s) and applicable laws.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you sServices, comply with our legal obligations, resolve disputes and enforce our agreements.

Data Transfers

You consent to INTTRA, its affiliates, third party service providers and Partners transferring your personal data to INTTRA, its affiliates and to the recipients referred to in this Privacy Policy in countries outside the European Economic Area (the "EEA") (including the United States of America) which do not provide a similar or adequate level of protection to that provided by countries in the EEA from which you may have submitted your personal data (if applicable).

Security

While no security procedures are fool-proof, INTTRA maintains industry standard appropriate technical and organizational measures to minimize the risk of unauthorized access to the data transmitted to and from, presented, and stored by INTTRA. The security of your personal information is important to us. When you log into our System, we encrypt the collection and transmission of all information using secure socket layer technology (SSL). However, INTTRA cannot guarantee the security of your personal data during its transmission to INTTRA. You shall take commercially-reasonable efforts to ensure the secure transfer of all data sent by you across data networks.

INTTRA's information security measures are designed to:

(a) ensure the security and confidentiality of personal data;

(b) identify potential threats or hazards to the security or integrity of personal data and protect against any anticipated threats or hazards; and

(c) protect against accidental or unauthorized destruction or loss or unauthorized disclosure or access to or use of the personal data.

To access certain parts of the System you will be required to create and maintain a user name and password, which will allow you as a User to access the secure customer section of the System. It is your responsibility to keep your user name and passwords secure and to not share this information with others.

Cookies

INTTRA may use temporary "cookies" which is a file sent to your Web browser and stored on your hard drive. These cookies permit our server to identify you when you visit the Websites in the future. Most Web browsers will allow you to be notified if a cookie is sent to you to enable you to decide if you want to accept it or not. Please be aware that if cookies are disabled on your computer, all features/functions of the Websites may not work properly. You can disable cookies from your computer system by following the instructions on your browser or at www.allaboutcookies.org. Cookies on our site are not linked to personal data.

In addition, a cookie file may also be placed on your hard drive by INTTRA or third parties providing services to INTTRA, including advertising companies. INTTRA and these companies may use data about your visits to our Websites and other websites in order to provide advertisements about transportation and financial services related products and services that you may be interested in. Data collected through these means are only collected in the aggregate.

When you use the Services, our servers automatically record information that your browser sends whenever you visit our Websites ("Server Logs"). These Server Logs may include information such as your web request, Internet Protocol address, browser type, browser language, the date and time of your request and one or more cookies that may uniquely identify your browser. We may combine the information we obtain with information from other services or third parties in order to provide you with a better experience and to improve the quality of our Services and advertising.

INTTRA may present links in a format that enables us to keep track of whether these links have been followed. We use this information to improve the quality of the Service, search technology, customized content, advertising and other business purposes. For example, when you click on a link displayed on the Websites, the fact that you clicked on the link may be sent to INTTRA. In this way, INTTRA is able to record information about how you use the Websites and Services, and in order to calculate how much the advertiser should be charged. In addition, clicking on certain buttons (e.g. "Request for Carrier Contact") may result in your personal data being sent to a third party, in order for the third party to contact you. You can decline to submit personal data, in which case INTTRA may not be able to provide certain Services to you. If you follow a link to any of third party websites, please be aware that these websites may have their own privacy policies and that INTTRA does not accept any responsibility or liability for these websites.

Notice, Access and Choice

If you are not directly entering your personal data on our site, and it is entered by a Company on your behalf, the following applies: We operate under the assumption that it is generally the Company's obligation as data controller to notify individuals about the purposes for which they collect and use information about them, how they can contact them with any inquiries or complaints, the types of third parties to which they disclose your information, and the choices and means they offer for limiting your use and disclosure. We make available to you this Privacy Policy so that you can better understand our data practices and whether they are consistent with privacy notices you may have received from your Company.

If you would like to access the personal data we hold about you to update it, please log into the appropriate part of the System and update this data within your account. You can also contact us at the email address below to access and update your personal data we hold about you.

You may have certain rights under applicable data protection laws which may include the right for you to receive a copy of the personal data that INTTRA holds about you

In addition, you may have a right to request that personal data is corrected, blocked or deleted if the data is factually incorrect, incomplete or irrelevant for the purposes described in this Privacy Policy. For any of these requests, please contact INTTRA at the address set out below or through the feedback button on the Websites and the System. We will respond to your request within 30 business days.

You may withdraw your consent for the processing of your personal data at any time, but if you do so, INTTRA may not be able to provide certain Services to you, including access to parts of the Websites. To cancel your account or request we no longer use your information to provide you Sservice or as otherwise outlined herein let us know by one of the these methods:

  • Send an e-mail with your request and current contact information to service@inttra.com; or
  • Send a letter with your request and current contact information to INTTRA Inc., Attention: Legal Department, One Upper Pond Road, Morris Corporate Center, Building D, Parsippany, NJ 07054.

Use of System

You represent and warrant that any data you provide to INTTRA is submitted in connection with transactions conducted for business purposes only. Access to and use of the System is subject to this Privacy Policy and to the applicable Agreement(s) between your Company and INTTRA.

Use of Corporate Web Site

On our corporate website, www.inttra.com, we have certain functionality. This includes testimonials, for which we have obtained the users permission to post their personal data.

Also, if you choose to use our referral service to tell a friend (email a friend, refer a friend, send to a friend, email a page, invite a friend) about any of our Websites, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. INTTRA does not store this information.

Our Website includes widgets, which are interactive mini-programs that run on our site to provide specific services from another company (e.g. displaying the news, opinions, music, etc) ("Widgets"). Personal information, such as your email address, may be collected from you through a Widget. Cookies may also be set by a Widget to enable it to function properly. Information collected by a Widget is governed by the Privacy Policy of the company that created it.

Changes to this Policy

INTTRA may at any time revise this Privacy Policy, and you are bound by such revisions and should therefore periodically revisit this page on the Websites for any changes to this Privacy Policy. INTTRA will post any changes to this Privacy Policy on the Websites and, if required under applicable law, will obtain your consent to the changes. If we feel it necessary to notify you of a breach of security to any of the Websites or other material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.
